ENBW lodges NAP complaint with EC

Germany's ENBW has lodged a formal complaint with the European Commission against Germany's National Allocation Plan
for carbon dioxide emissions, it said Thursday. ENBW has asked the commission to reject the law, which was passed by the
German parliament in late May. As a major nuclear power plant operator, ENBW believes it is strongly disadvantaged by the NAP.
The utility severely criticized the proposal that nuclear operators must acquire new emissions certificates for replacement
capacity, while other operators can transfer certificates to new plants. With an assumed certificate price of Eur10 ($12.09),
the financial disadvantage for ENBW would add up to a total of Eur1-bil between 2005 to 2020. "It is absurd that a company
like ENBW which is particularly efficient with emissions compared to (its) competitors, should be forced to buy more
certificates," said chief executive Utz Claassen. He said he was confident that the complaint would be successful. ENBW
has received political support from the government of Baden-Wurttemberg, where it is based. An ENBW spokesman told
Platts that the utility expects the EC to take a decision very soon. Should the complaint be dismissed, ENBW would
undertake legal steps in Germany, he added.
